Abstract

Crimes against property accompanied by violence have historically been regarded as among the most serious threats to public order and social stability. Such offences do not merely result in economic loss to individuals; they generate fear, insecurity, and a pervasive sense of vulnerability within communities. When violence is employed to dispossess individuals of their property, the impact extends beyond the immediate victim and undermines confidence in the State’s ability to maintain law and order. Consequently, criminal law has consistently treated violent property offences with heightened seriousness.
.It involves the participation of a group acting with a shared criminal design, the use or threat of violence, and the deliberate creation of fear. The presence of multiple offenders acting in concert significantly magnifies the gravity of the offence and poses a direct challenge to both individual security and the authority of the State.
Under the Indian Penal Code, 1860 (IPC), the offence of dacoity is codified primarily under Sections 391 to 395. Section 391 defines dacoity as robbery committed or attempted by five or more persons acting conjointly, while subsequent provisions prescribe punishment and deal with aggravated forms of the offence, including cases involving murder or grievous hurt. The IPC framework also addresses preparation and attempt, reflecting the legislature’s intent to criminalise not only the completed offence but also the organised planning that precedes it.
