Abstract

Despite progressive laws, women in India continue to face significant barriers in inheriting and owning property. This paper critically examines the legal framework governing women's inheritance rights, focusing on the Hindu Succession Act, 1956 (amended in 2005), and the Muslim Personal Law. It highlights gaps in legislation, patriarchal social norms, and poor implementation that perpetuate gender disparities in property ownership. Analyzing landmark cases and data, the study argues for reforms to ensure substantive equality, including addressing coparcenary rights, agricultural land ceilings, and awareness campaigns. Bridging this gender gap is crucial for women's empowerment, economic independence, and achieving SDG 5 (Gender Equality).
