Abstract

Digital payment systems in India have undergone a significant transformation from traditional paper-based instruments to a technologically advanced and interoperable ecosystem. This study examines the evolution of payment systems in India and critically analyses the legal and regulatory challenges arising from this transformation. The research focuses on the statutory framework governing payment systems, particularly the Payment and Settlement Systems Act, 2007, along with the regulatory role of the Reserve Bank of India and the National Payments Corporation of India.

The study further analyses consumer protection issues, liability for unauthorised electronic transactions, grievance redressal mechanisms, KYC and anti-money laundering compliance, cybersecurity concerns, and data protection obligations under the Digital Personal Data Protection Act, 2023. Special attention is given to emerging technologies such as blockchain, artificial intelligence, smart contracts, and the legal implications of cryptocurrencies and Central Bank Digital Currency (e₹).

The research adopts a doctrinal approach to examine statutes, regulatory directions, and judicial interpretations. It concludes that while India’s payment infrastructure is globally advanced, continuous legal reforms and stronger regulatory mechanisms are required to address fraud risks, data privacy concerns, and accountability in the fintech ecosystem.
